New York Patents and Patent Lawyers

September 3rd, 2008

So you have eventually come up with that better mouse trap and now the New York Companies are starting to knock at your door. The only problem you have encountered so far is you haven’t applied nor received a patent on your new mouse trap design.

Many up and coming New York inventors often wondered what the value is in obtaining a patient on their small inventions. Let me quickly relate to you that many small inventions have made their creators multi-million dollars in sales of the product. It definitely appears that the small ideas are just as valuable as the larger concepts when it comes to inventions, therefore after you have successfully tested and finalized your new mousetrap it is high time to make a quick visit to one of New York’s patent attorneys for further advice. These patent attorneys are members of the New York legal profession who specialize in all aspects associated with representing inventors who desire to protect their ideas from theft. These specialized patent lawyers can help you obtain your patent as well as to represent you in any legal matters relating to your invention.

In New York, there are patent attorneys as well as patent agents who basically have the same type of license and both are able to represent their clients with the Patent Office. Both may prepare applications, file infringement papers and prosecute any suspected patent violations for their clients.

The patent attorneys are permitted to practice law in one state of the United States. Since its initial initiation in 1790 there have been approximately 62,000 attorneys who have successfully passed the necessary exams to be qualified as a patent Lawyer.

An interesting note here is that of these 62,000 practitioners there are only 27,000 which are licensed to also practice law. California possesses the most patent attorneys of any state in the union followed closely by the state of New York and then Texas. Delaware on the other hand has an abundance of Patent Lawyers Per capita other then DC.

Patent Agents usually receive an education leading to a technical type of degree such as engineering, physics or chemistry in order to fully understand their client’s specific invention. These necessary academic credits can be easily met with the earning of a bachelors degree in one of the natural science fields. Degrees earned in social science, Philosophy or mathematics does not qualify an individual for this requirement. They must of course, still pass the Examination necessary for advising clients but they can not practice law in court cases. Lastly, the patent attorney candidates must possess a “good moral character as well as a firm reputation.”

An important step in the patent process is the necessary patent search. During this phase of the licensing an involved check is accomplished on your patent to ensure that there are no prior patents issued that are similar or duplicated of your invention. So important is this step that it must usually be completed before any additional work can be accomplished on the patent. You must ensure that you are the first to have the idea or you will waste a considerable amount of money trying to obtain a patent.

You can always perform the search yourself or obtain the services of a New York Patent Lawyer to do it for you. There are 2 types of searches which you can do. The first type is a paperwork kind of search. Usually this is conducted within the confines of the patent office’s search room. The second search is by use of the internet to search for an invention.

Next you will need to write your application up for your patent and then properly file it. Oh yes at this point in time we can not forget to pay the necessary filing fee which will be due the Patent Office. After your patent application is received at the Patent Office it will be assigned to an examiner to evaluate it. At this time he will conduct his own search and within 36 months you will receive his review papers. These papers will accept, object to or reject your patent. If they are accepted then a patent will be issued.

Obtaining a patent can be a time consuming task however in the interest of your invention it is well worth it.

Affordable Health Insurance in Florida – A Domestic Crisis?

August 25th, 2008

Health Insurance can mean a safety net for you and your entire family. In this uncertain world of manmade and natural disasters, we all need a provision of basic security. But more and more often, the term is coming to mean a major worry factor in most of our lives. The number of those without insurance is no longer limited to just the poor, but increasingly most of us. A recent study detailed that nearly 47 million people, i.e. around 16% of Americans, do not have health coverage. Florida ranks 46th out of the 50 states in the number of uninsured- a whopping 21.2 %. The call of the day therefore, is to take immediate steps for providing affordable health insurance.

Most people are provided health insurance cover by their employers. However, the increasing number of people switching jobs regularly, or opting for either self employment or early retirement, is contributing to a proportionate increase in the number of uninsured persons. They are then left with no option but to purchase individual insurance plans which can be quite expensive. However, the cost of doing nothing can be far worse. Statistics show that more than half of all personal bankruptcies in the US are caused by medical bills. Having health insurance protects us from high health care cost that most of us would be unable to pay in any other way.

Although different kinds of health insurance plans are available, in Florida, as in most other states, access to individual health insurance is not guaranteed. Insurance agencies are free to refuse to sell you a policy, or to restrict your benefits depending upon your health status, age, gender, the kind of coverage you want to buy and other circumstances. What makes the problem worse, is that the state’s risk pool which ensures medical coverage to those who cannot medically get private insurance (due to a pre-existing illness) – has been closed to new enrollees since 1991.

On the brighter side, low-income residents who cannot afford to buy private insurance with high premiums, are offered help through the Medicaid and Florida KidCare programmes which offer free or subsidized health insurance coverage, direct medical services and other help. Also most people are able to deduct their health insurance premiums from their Federal taxable incomes. This provides them with an important tax saving and must surely contribute towards making health insurance more affordable.
The Sunshine State is a leader in biomedical innovation and Medicaid Reform. However it lags behind in providing safe medical care and affordable health insurance. Florida health insurance ranks ‘high’ as regards to the cost of healthcare as compared to other states, while the quality of that care is termed as ‘low’. Healthcare options need to be expanded, home and community based services made more accessible. Focus needs to be given to awareness and prevention of substance abuse and mental illness. Funding for mental health treatment is so poor as to rank the state almost last in the nation. Fitness and nutrition initiatives also require attention.
The absence of reliable health care and affordable health insurance in Florida is therefore a big domestic crisis and needs to be worked out, whether through universal health care, guaranteed issue or expansion of state risk pools. Only in this way will the state population be guaranteed the peace of mind that they deserve, not just in case of emergencies, but also for routine and preventive medical care.

Fire Department Training : Courage in the Face of Adversity

August 24th, 2008

In today’s world, corruption and greed have become bywords. However, the Fire Department, adhering to its core values of Integrity, Commitment, Honor and Selflessness, continues to shine as a beacon of hope. The public finds a safe haven in which to repose its trust, firmly believing that someone is looking out for them. At the same time, firefighters need to practice extreme caution themselves. Hence, proper fire training is of crucial importance to the safety of not just the citizens they serve, but of the firemen themselves.

The first truth of the job is that firemen may do everything by the rulebook and still get injured or killed. What ultimately serves them is the number of hours spent training and the amount of experience gained. Alongside, it is of vital importance to have adequate number of fire rescue personnel on the fireground and proper fire fighting equipment and skills. As the saying goes in the Fire Department, “You have two hands, bring two tools”. Implementation of standard operating guidelines, thorough knowledge of the basics of firefighting and the capability to keep a cool head while making informed decisions in the face of imminent danger are the best foundation for safety. And this is what Fire Department training strives to do.

Fire training systems provide a controlled environment for firefighters to learn about myriad fire behavior and the best procedures and different techniques for approaching different situations. Realistic settings duplicate the stressful conditions of emergencies and allow seasoned firefighters to hone their skills adequately while newbies are taught the rules of the game. Training is given under different headings –

• Live Fire
• Flammable Liquid and Gas Fires
• Forcible Entry
• Car Fires
• Urban Search and Rescue
• Disaster Management
• Hazardous Materials

Not to be left behind, however, are basic yet vital skill sets such as power saw operations, hoseline estimate and stretching, nozzle selection, nozzle team tactics, hydrant, ladder and preconnect knowledge, SCBA emergency skills, R—EBT (Reilly Emergency Breathing Technique), ventilation tactics and Firefighter survival tactics. Special attention is given to Fire Department Equipment like fire extinguishers (powder, foam, CO2, water) pressure gauges, valves, hoses and nozzles, fire blankets, gear for Hazardous Materials, smoke detectors and fire alarms for optimum and effective utilization.

It is difficult to overestimate the importance of fire training. Firefighters require thorough knowledge of different aspects of the game because each category of Fire Department Training incorporates further sub-categories. For instance, Liquid and Gas Fire training includes ruptured gas line fires, fuel and chemical spill fires, relief valve and boil over fires and pressurized tank fires. Similarly, conditions while fighting fires at high rises are unique and very different from those at a fire at the top level of a flat-roof ordinary construction. Issues such as locating the fire, setting up the standpipe system, deciding the primary point of attack, communicating with occupants and effective evacuation procedures have to be properly addressed to avoid tragedies.

Disasters, manmade or natural, do not come with warnings. They have to be faced promptly with a skill set above the ordinary. Fire Department Training strives to arm its firefighters with all possible weapons to combat emergency situations in urban and rural scenarios. As firefighters joke, “we gotta know how to put the wet stuff over the red stuff.”

Show the World You Have Arrived: Get Seen at the Golf Course

August 23rd, 2008

Have you ever wondered what it takes to climb the social ladder? I for one found it quite a challenge to learn the ropes where that is concerned - get seen here, get noticed there… joining to a golf club is a great idea to make sure you are in the right social circle and at the right occasions. This may seem a trifle undermining to the occasional reader, but one must understand that the corporate world is a place where competition is as fierce as anywhere else, if not more. Most ‘top brass’ employees will give their week’s pay for a game with the CEO at the golf course, and not without undue reasoning behind the idea. More often than not, it is one of the only methods one has at hand to get noticed at all, what with literally thousands of employees competing for their boss’s attention at the office premises. OK, things are not always as bad as that, but we have made our point about the social reasons one may have for being at the golf course. A bit more on the more aesthetic reasons…after all, there is more to golf than the boss or the rungs of the social ladder.

Golf courses are usually extremely picturesque and soothing to be in. Many senior citizens take up the game simply to make their days interesting as well as walk in soothing locations on the gold courses to while away their days of retirement in peace and solace. The golf clubs offer much more than that of course. They organize regular competitions and training camps as well, for those who are new to the golf course. Once you are hooked on to the game, you will love to play a game or two with other members of the club to evaluate your level of skill in comparison. If nothing else, you make great friendships with other like-minded people on the golf course. If you are dedicated and skilled, you can also win a lot of money at the competitions. Very often smaller clubs make a united effort to organize an eventful day of competition at one of the golf courses.

Places like Florida and Las Vegas are favorite destinations for golfing holidays. While you may live in northern regions where the winters get really snowy, you could fly down to one of the Las Vegas golf courses for a quick vacation in lovely weather. Not only do golf holiday packages offer you the golf experience, but the clubs usually encourage and organize sight-seeing facilities, lounges, restaurants and even shopping outlets at some of the Las Vegas golf courses. Once you are hooked on to the game of golf, you will never have a problem about how you are going to spend your free time again!

Personal Injury and Wrongful Death Attorneys in a “Sue Happy” America

August 22nd, 2008

Lawsuits such as personal injury, medical malpractice and wrongful death, are becoming a very lucrative business for Americans and their attorneys. According to the U.S. Department of Justice, the Bureau of Justice Statistics, “In 2001, plaintiffs in the 75 largest counties won just over half of the 12,000 general civil cases at trial, with 442, or 4% awarded $1 million or more.” 1

Here’s another statistic for you: “An estimated $4 billion in damages were awarded to plaintiff winners in civil trials.” 1

Now, there are people with definite reason to file these types of lawsuits. For instance, in 2004, a teen died in Tucson, Arizona after contracting the Norwalk virus from drinking water contaminated by feces. His parents filed a wrongful death suit that was settled out of court for $3 million. 2 That may sound like a lot of money, but will it really replace the life of a child?

Other cases, however, are not so clear-cut; the area of law that covers personal injury and wrongful death has become murky at best, due, in part, to the actions of attorneys. The phrase “ambulance chasers” comes to mind. Personal injury and wrongful death attorneys now have commercials running 24/7, all with a list of situations, all hinting at the promise of large amounts of money, all saying, “We don’t get money unless you do.”

Most people have seen at least one movie or read one book where someone gets hurt and then, at the hospital, is bombarded by attorneys telling them how much money they can get for the injured. Sadly, this isn’t a fictional situation. You may not be able to find an attorney for divorce, child custody, or various other cases where you need one, but if you get hurt and end up in the hospital, all you have to do is lift your head and look around.

Did you slip at work, fall and hit your head? Hire us; the company may have workmen’s comp, but we can get you more money.

Did your spouse take a medicine that caused their death? Even though they read the fine print, knew it was a possibility and agreed to take the medicine anyway, it’s the company’s fault that they died. Hire us; we’ll make them pay.

Did your doctor perform a procedure that you agreed to, after you said you understood the possible complications, and there were complications? Hire us; we’ll make sure that doctor won’t be able to do that to anyone else.

There’s a heavy dose of sarcasm, but there’s also a prevalent thought running through those questions. “Nothing that happens to you is your fault. There is no such thing as an accident. If you get hurt or hurt yourself, we’ll find a party that can be blamed and sue the pants off them.”

If you’re skeptical or feel that this is unfair, I submit to you this question: Why do McDonald’s coffee lids and cups have “Caution, contents are hot” written on them? Because someone was burned by hot coffee, hired a personal injury and wrongful death attorney, and sued the company for getting hurt.
